By registering with Zurich Minor Athelic Association, you agree to the following conditions of registration. The online registration will ask you to accept this "Legal Click-through Agreement" as part of the registration process. As of 2001, legislation was passed throughout Canada that made a "Click-through Agreement" on the internet as legal as a signature.
ZMAA Waiver
I, the applicant, certify the information on the online registration form to be true and consent to the Player participating in the hockey program of Zurich Minor Athletic Association (hereafter noted as ZMAA). I further agree to abide by and be subject to the consitution, by-laws, regulations, rules, and decisions of ZMAA, Ontario Hokcey Federation and Hockey Canada.
ACKNOWLEDGMENT AND ASSUMPTION OF RISK
I am aware and acknowledge that hockey can be a physical game in which injuries may occur and my participation in ZMAA activities can involve risks. I hereby apply for registration of the player in the activities of ZMAA, agreeing to accept the reasonable risk inherent in the game of hockey including the risk of serious personal injury. The applicant, for himself, herself, themselves, their next of kin, executors, administrators assigns, hereby irrevocably releases the ZMAA, its executive members, directors, coaches, assistant coaches, trainers, managers, referees, officials, and employees from all manner of claims or causes by actions in any way related to personal injury or property damage sustained by the registered player and/or the applicant in the course of participating in, viewing, or traveling to or from any of the games, programs or activities sanctioned by ZMAA. I agree to extend this Waiver to include off-ice activities conducted by the team.
I acknowledge the contagious nature of the COVID-19 virus and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COIVD-19 by attending ZMAA activities. I hereby release and agree to hold ZMAA harmless from, and waive on my behalf, my heirs, and any personal representatives, any and all causes of actions, claims, demands, damages, costs, expenses, and compensation for damage or loss to myself and/or property that may be caused, or that may otherwise arise in any way in connection with any activities related to ZMAA. I understand that this release discharges ZMAA from any liability or claim that I, my heirs, or any personal representatives may have against the ZMAA with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any activities within ZMAA. I hereby accept and consent to the collection, use, and potential disclosure of personal information regarding measures aimed at preventing and mitigating COVID-19 exposure at ZMAA activities.
GENERAL
I, the applicant, agree to abide by the following conditions of membership as set out by ZMAA:
a. I am in good health and am physically and mentally capable of participating in ZMAA activities in which I intend to participate.
b. ZMAA adheres to the age classification system approved by Hockey Canada.
c. New registrants must provide ZMAA with a true copy of their birth certificate at the time of registration.
d. Players will, at all times, on and off the ice, conduct themselves in a sportsmanlike manner, according to the ZMAA Code of Conduct. Infractions of the rules may result in the imposition of severe penalties, including suspension from further play.
e. All jerseys and goalie equipment issued by ZMAA are the property of ZMAA.
f. All players in ZMAA must wear a CSA approved type helmet, which fastens under the chin, together with a CSA approved facemask. They must wear protective devices such as athletic supports with cups, shin guards, hockey gloves, neck/throat protectors, shoulder pads, elbow pads, kidney protectors, hockey pants, mouth guard etc. In addition, goaltenders must wear an approved type of facemask, as well as an approved head and throat protector. Insurance is void if a player's helmet is removed while he/she is on the ice or on the bench.
g. The responsibility for the transportation of players to and from the games or practices rests with the parents.
PARTICIPATION BY MINOR(S)
If I am signing this Agreement on behalf of one or more person(s) who are under the age of 18 years (each, a “Minor”), I confirm the following:
a. I have entered the full legal name and year of birth of each Minor in the requisite fields.
b. I am the parent or legal guardian of each Minor, or otherwise have the necessary legal authority to enter into this Agreement on behalf of each Minor, and hereby accept all the terms and conditions contained in this Agreement on behalf of each Minor.
c. I have assessed the risks and dangers associated with ZMAA activities, having regard to the specific abilities and circumstances of each Minor, and I voluntarily consent to each Minor participating in ZMAA activities, despite such risks and dangers.
d. If any Minor is injured while participating in ZMAA activities, I accept all responsibility and liability for any such injuries and agree to defend, indemnify, and hold harmless the Releasees from all claims or suits for personal injury, property damage or otherwise, which are brought by or on behalf of the Minor, and which are in any way connected with the Minor’s participation in ZMAA activities.
CONSENT TO USE OF IMAGE AND LIKENESS
I acknowledge that ZMAA may take photographs and/or video recordings of me while I am participating in ZMAA activities. I hereby grant ZMAA express permission to use my name, likeness, image, voice and/or appearance, as such may be embodied in any photographs, video recordings, digital images, and similar media, taken or made by ZMAA. I agree that ZMAA shall have complete ownership of such media, including all copyrights, and may use same for promotional purposes, including on websites or social media accounts maintained by the ZMAA and on physical advertising or informational materials, such as brochures, pamphlets, and articles. I acknowledge that I will not receive any compensation for the use of such media and hereby release ZMAA from all claims which arise out of or are in any way connected with such use.
